    If you are the owner (or if you are authorized to act in behalf of the owner) of copyrighted material posted to The Fossil Forum without permission, you may fill out a Digital Millennium Copyright Act (DMCA) takedown notice and send it to the following designated DMCA agent:

    The DMCA takedown notice must:
     

    1. Identify the original copyrighted work(s) you claim have been infringed upon;
    2. Identify the location (exact URL) of the offending material(s) on The Fossil Forum;
    3. Identify the username of the alleged infringer(s);
    4. Include your legal name, address and phone number for contact purposes;
    5. Include a statement that your notice is in "good faith;"*
    6. Include reasons for the good faith belief that the allegedly infringed upon work is not covered under fair use;
    7. Include a statement that, under penalty of perjury, you are the owner of (or designated agent of) the allegedly infringed upon material(s);
    8. Include a statement that all information contained within the takedown notice is true and accurate;
    9. Include the signature of the owner (or agent of the owner), along with the date.
       

    *Copyright holders must first conduct an analysis of whether use of the material constitutes fair use and they must have a good faith belief that it does not before submitting a DMCA takedown notice. [1] Failure to consider fair use may give rise to a claim of failing to act in good faith.
