I went to rattlesnake this morning to round up some micro matrix. I found some shells scallop but not sure they are fossils or someone threw them into the creek.

I have seen quite a few places in Gainesville where people throw in scallop shells...I'm pretty sure that's what you have there.

These are the common "Bay Scallop" (Argopecten irradians) that people snorkel for on the west coast of Florida.

They are also raised commercially. These don't look like a commercially raised batch, because those are normally all the same size and shape, since they are raised in batches and are closely related. These could be a wild collected batch that somebody snorkeled for and ate, then threw the shells in the river, or it could be that they really are "fossils" that are quite old. The A. irradians dates back to the Pleistocene.

Your question could only be answered by taking a look at what other associated specimens were found with these shells. Are there other materials that might be Pleistocene marine?

Another way that Pliestocene shells get moved around is when canals get dredged, and when the Pleistocene shelly materials are used as construction materials, as a "fill dirt". This makes finding fossils easy, but also makes trying to determine their age to be very frustrating.
