Yes, they have to have direct contact.  I usually wet the fossil first just so that the flakes stick.  When you are satisfied with the result, make sure you soak the fossils in water for several days, changing the water daily and brushing them with a tooth brush daily, otherwise your fossils will turn white with KOH residue.  The water soaking pulls the KOH out of the fossils.

Is the residue permanent? Looks like one of the brachiopods has a white spot.

Not if you soak them as described above.  Even if you let it dry already, it will come out using the process described above.
