Can someone identify this for me? I think it's a crab claw, but is it a fossil? I found it shelling in St.Andrews state park in Panama city Florida.

It's a crab claw. Arthropods have an exo-skeleton. 

She is asking if it is a fossil, rather than modern. 

 

Very difficult to tell just from pictures. Looks do not always translate well into photographs.

That said, I would lean towards modern crab claw, but I think it would need to be examined in hand to determine for sure.
